RPVS in public procurement

RPVS in public procurement in practice

Winning a tender and then missing the signing date happens to firms that only think about RPVS once they are told they have won. You may submit a bid without being registered. Under Slovak Act No. 343/2015 on public procurement, however, the contracting authority must not sign with a bidder who is not in the register if the contract exceeds the statutory threshold.

We help you time the registration to the stage of the procurement, ideally running it in parallel with your bid. We also review your subcontractors, because the duty applies to anyone with a share above 30% of the contract value. On long construction and IT contracts, concessions or dynamic purchasing systems, we make sure the entry remains valid for the whole term.

What we help with

  • We assess the registration duty while you prepare the bid.
  • We start the registration in parallel with your submission.
  • We calculate each subcontractor's share of the contract value.
  • We prepare documents for registering subcontractors above 30%.
  • On amendments or a change of subcontractor we assess whether a new verification is needed.

Worth knowing

Bid versus contract

No RPVS entry is needed to submit a bid. The duty arises before signing a contract worth more than €100,000, or more than €250,000 in total for recurring payments.

Subcontractors above 30%

Any subcontractor whose share exceeds 30% of the contract value must also be registered. This follows from Section 2 of Act No. 315/2016.

Check before signing

The contracting authority checks the register itself before signing. Without an entry it must not conclude the contract with you.

Foreign shareholders

Apostilles and certified translations cannot be rushed. If you have an owner abroad, start the registration before submitting the bid.

Common questions

  • The contracting authority will not sign with you and may turn to the next bidder in line. You can ask for an extension, but the authority does not have to grant it.
  • For a simple limited company with a known structure, the court usually decides within 5 working days of a complete application. With foreign owners, the pace depends mainly on apostilles and translations.
  • The subcontractor is responsible for its own entry. The main supplier should still check that every subcontractor above the 30% mark is registered, or its own contract may be at risk.
