MiCA Licence: CASP Authorisation in Slovakia

MiCA Licence: CASP Authorisation in Slovakia in practice

Ten services are listed in Article 3(1)(16) of MiCA, and anyone providing even one of them needs authorisation. They include custody of crypto-assets, running a trading platform, exchange, order execution, advice and portfolio management. In Slovakia the application is assessed by the National Bank of Slovakia. Its authorisation then works as an EU passport, allowing you to operate in other member states after notification.

The application runs to more than 20 annexes, and the National Bank expects them to fit together and reflect how your business really works. The business plan, the AML policy and the crisis management plan usually draw the most questions. We help you define your services precisely, prepare the documentation, get your directors ready for the interview and deal with the regulator throughout. Technical parts such as cyber security are prepared with your IT team or external specialists.

Worth knowing

Who applies and where

A Slovak entity applies to the National Bank of Slovakia, designated by Act No. 248/2024 Coll. as the licensing and supervisory authority. The application may be filed in Slovak or English.

Qualifying shareholders

The applicant must describe its ownership structure and identify qualifying shareholders holding, directly or indirectly, more than 10%, as well as the beneficial owner.

EU passport

Authorisation from the National Bank is valid across the EU. The holder notifies the National Bank of its intention to operate in another state, and the National Bank passes the notification on. The passport covers only the services authorised.

Fee

An administrative fee is payable with the application according to the National Bank's published tariff.

Common questions

  • Anyone providing at least one of the ten crypto-asset services in Article 3(1)(16) of MiCA, such as custody, running a trading platform, exchange, order execution or advice. The licensing authority is the National Bank of Slovakia.
  • Yes. Authorisation granted in another member state allows you to provide services across the EU on the basis of a notification. You then do not need a separate Slovak licence.
  • CASP authorisation covers providing services such as an exchange or custody. An ART issuer needs a separate authorisation under Articles 16 to 47 of MiCA. An EMT issuer must be a bank or an e-money institution and comply with Articles 48 to 58.
