Debt recovery for businesses

Debt recovery for businesses in practice

A company with dozens of customers deals with unpaid invoices all the time. Chasing them one by one takes up the time of the accounts team and the sales staff, and meanwhile the debts get older. What helps is a clear rule on when an invoice moves from internal reminders to a lawyer, and a single process from the letter before action through the payment order to enforcement.

With companies whose overdue invoices keep coming, we agree a framework contract. It sets out when you hand a debt over to us, which templates are used, how the fee is calculated and how often you receive a status overview of each case. Undisputed debts go through payment orders, disputed ones are handled individually. We file claims in insolvency proceedings and use EU procedures for debtors in other member states.

What we help with

  • Framework contract with rules for handing over debts
  • Letters before action and payment orders
  • Court disputes after the debtor objects
  • Working with the court bailiff
  • Filing claims in insolvency proceedings
  • Regular status reports on your receivables

Worth knowing

Fees

Fees are agreed in writing in advance. For claims between businesses, alongside the basic fee under Slovak Decree No. 655/2004, the agreement may include a component that depends on recovery.

European order for payment

For a debtor in another EU member state, a European order for payment under Regulation (EC) No 1896/2006 can be used. Once enforceable, it is recognised throughout the EU.

Legal costs

If you succeed in court, the costs of legal representation are awarded against the debtor.

Common questions

  • Mainly when unpaid invoices arrive regularly. For occasional cases, a separate engagement for each matter is enough. We tailor the scope to your needs.
  • Yes, from debtors in other EU countries. We use the European order for payment, the European Enforcement Order for uncontested claims (Regulation No 805/2004) and the Brussels I bis Regulation (No 1215/2012) on recognition and enforcement of judgments.
  • The claim is lodged in the insolvency proceedings under special rules. We prepare the filing, attend creditors' meetings and represent you in related disputes.
